Welcome to Mind Spell. These Terms and Conditions ("Terms") govern your use of the Mind Spell mobile application (the "Application") operated by Adisoft ("we", "us", or "our").

By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Application.

1. License to Use

Subject to your compliance with these Terms, Adisoft grants you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the Application for your personal, non-commercial entertainment purposes.

2. Virtual Goods and Account Ownership

We retain all rights, title, and interest in and to the Application, including all content, character designs, 3D assets, graphics, sound effects, and gameplay systems. Regarding in-game progress and assets:

• No Ownership: You acknowledge that you do not own the account you use to access the game, nor do you own any virtual currency (Coins), character upgrades (HP/POWER levels), or leaderboard ranks (collectively, "Virtual Goods") accumulated through gameplay. You merely have a limited license to use them within the Application.
• No Real Money Trading (RMT): Virtual Goods and accounts have no real-world monetary value. Selling, trading, transferring, or exchanging accounts, high scores, or Virtual Goods for real money or external compensation is strictly prohibited and will result in immediate account termination.

3. Purchases and In-Game Economy

• Virtual Currency & Ad Rewards: In-game currency (Coins) is earned through gameplay or by voluntarily viewing Rewarded Advertisements. Rewarded Ads are optional and subject to availability and internet connectivity.
• In-App Purchases (if applicable): If the Application offers digital content or Virtual Goods for purchase, all transactions are processed through platform app stores (Google Play Store / Apple App Store).
• All Sales are Final: All purchases and reward redemptions are final and non-refundable, except where required by applicable law or the direct refund policies of Google Play or the App Store.
• No Subscriptions: The Application currently does not contain any auto-renewing subscription services.

4. Code of Conduct and Anti-Cheating

To ensure a fair and competitive environment on global leaderboards (Best Score and Total Boss Kills), you must adhere to the following rules:

• No Cheating or Speed Hacks: You may not use, develop, or distribute hacks, mods, memory editors, automated bots, time-manipulation tools, or third-party software designed to alter game parameters, equation response times, or score calculations.
• No Score or Offline Data Tampering: You may not forge, alter, or manipulate offline pending run data, local save files, or API requests sent during account sync or Best Progress Merge.
• Zero Tolerance Policy: Adisoft reserves the right to investigate and immediately ban, reset leaderboard records, or terminate any account suspected of cheating, score tampering, or violating these Terms, without prior notice or compensation.

5. Intellectual Property Rights

All intellectual property rights in the Application—including but not limited to the Mind Spell brand, code, game design mechanics (Drag & Cast systems, Risk Overdrive, Counter Equation), 3D visuals, sound design, and UI layouts—belong to Adisoft or its licensors. You may not copy, modify, distribute, reverse-engineer, or decompile any portion of the Application.

6. Limitation of Liability

The Application is provided on an "AS IS" and "AS AVAILABLE" basis. Adisoft does not warrant that gameplay, online leaderboards, or account synchronization will be uninterrupted, error-free, or compatible with all device configurations.

To the maximum extent permitted by law, Adisoft shall not be liable for any direct, indirect, incidental, or consequential damages arising out of your use or inability to use the Application, including data loss resulting from device corruption or unlinked guest accounts.

7. Termination

We may suspend or terminate your access to the Application or account synchronization services at our sole discretion, without prior notice, for conduct that violates these Terms, interferes with leaderboard integrity, or is harmful to other users or our business interests.

8. Governing Law

These Terms and any dispute arising out of your use of the Application shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law principles.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any significant changes by updating the "Effective Date" at the top of this document. Your continued use of the Application after changes are posted constitutes your acceptance of the revised Terms.
